These Terms of Use (the “Terms”) govern your access to and use of theacademylabllc.com (the “Site”), operated by The Academy Lab LLC. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Academy Lab LLC (“The Academy Lab”, “we”, “us”) is a limited liability company organized under the laws of the State of New Mexico, United States of America.

Informational purpose
The Site describes who we are and what we do. Its content is provided for general informational purposes only and may be updated or removed at any time without notice.
No professional relationship
Browsing the Site or submitting an inquiry does not create a client, coaching, advisory, medical or other professional relationship between you and The Academy Lab. We are engaged only through a separate written agreement signed by both parties. Nothing on the Site is an offer or a binding commitment to provide services.
No professional advice
Content on the Site is not medical, health, nutritional, psychological, legal or financial advice, and must not be relied upon as such. Please read our Disclaimer, which forms part of these Terms.
Inquiries and communications
- You agree to provide accurate, current information in our inquiry form and not to impersonate any person or organization.
- Do not send confidential or sensitive personal information (such as health, medical or performance records of identifiable athletes) through the Site.
- Communications sent through the Site are not confidential and are not protected by any duty of confidentiality until a written agreement is in place.
Intellectual property
All content on the Site — including text, graphics, logos, the “The Academy Lab” name and marks, methodology descriptions, layout and design — is owned by The Academy Lab or its licensors and is protected by United States and international intellectual property laws.
You may view the Site and print or download pages for your own personal, non-commercial reference. You may not copy, reproduce, republish, distribute, publicly display, modify, or create derivative works from any part of the Site, nor use it to train automated or machine-learning systems, without our prior written permission.
Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in breach of these Terms.
- Attempt to gain unauthorized access to the Site, its servers, or any related systems or data.
- Interfere with, disrupt, or place undue load on the Site or its infrastructure.
- Use automated means (bots, scrapers, crawlers) to harvest content or data from the Site.
- Submit false information, or transmit malware, spam or any harmful code.
Third-party links
The Site may link to third-party websites, studies or resources. We do not control them and are not responsible for their content, availability, policies or practices. A link is not an endorsement, and your use of any third-party site is at your own risk and subject to that site’s terms.
Availability
We aim to keep the Site available but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the Site at any time, without notice and without liability.
Disclaimer of warranties
The Site is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any content is accurate, complete or current.
Limitation of liability
To the maximum extent permitted by applicable law, The Academy Lab LLC and its members, managers, officers, employees, contractors and agents shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or for any personal injury arising from reliance on Site content, whether based in contract, tort (including negligence), strict liability or otherwise, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Site shall not exceed one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you. In such cases our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend and hold harmless The Academy Lab LLC and its members, managers, employees and agents from and against any claims, demands, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any rights of a third party.

Our handling of personal information is explained in our Privacy Policy, which forms part of these Terms.
Changes to these Terms
We may modify these Terms at any time. Changes take effect when posted on this page, and the “last updated” date above reflects the current version. Your continued use of the Site after changes are posted means you accept the revised Terms.
Governing law and venue
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of New Mexico, United States of America, without regard to its conflict-of-law principles. You agree that any such dispute shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts.
Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it.
Language
These Terms are published in English and Spanish. The English version is the binding version. The Spanish translation is provided for convenience only; in the event of any conflict or discrepancy, the English version prevails.

Consultas y comunicaciones
- Te comprometes a facilitar información veraz y actualizada en el formulario de consulta y a no suplantar a ninguna persona u organización.
- No envíes información confidencial ni datos personales sensibles (como historiales médicos, de salud o de rendimiento de deportistas identificables) a través del Sitio.
- Las comunicaciones enviadas a través del Sitio no son confidenciales ni están protegidas por deber de confidencialidad alguno hasta que exista un acuerdo escrito.

Uso aceptable
Te comprometes a no:

El Sitio puede enlazar a webs, estudios o recursos de terceros. No los controlamos ni somos responsables de su contenido, disponibilidad, políticas o prácticas. Un enlace no implica respaldo, y el uso de cualquier sitio de terceros es por tu cuenta y riesgo y queda sujeto a las condiciones de dicho sitio.
Disponibilidad
Procuramos mantener el Sitio disponible, pero no garantizamos un acceso ininterrumpido. Podemos suspender, retirar o restringir todo o parte del Sitio en cualquier momento, sin previo aviso y sin responsabilidad.
Exclusión de garantías

Limitación de responsabilidad
En la máxima medida permitida por la ley aplicable, The Academy Lab LLC y sus socios, administradores, directivos, empleados, contratistas y agentes no serán responsables de daños indirectos, incidentales, especiales, consecuentes, ejemplares o punitivos, ni de la pérdida de beneficios, ingresos, datos, fondo de comercio u oportunidades de negocio, ni de daños personales derivados de la confianza depositada en el contenido del Sitio, ya se basen en contrato, responsabilidad extracontractual (incluida la negligencia), responsabilidad objetiva u otra, y con independencia de que se nos hubiera advertido de la posibilidad de tales daños.
En la máxima medida permitida por la ley aplicable, nuestra responsabilidad total acumulada derivada del Sitio o relacionada con él no excederá de cien dólares estadounidenses (100 USD).
Algunas jurisdicciones no permiten la exclusión de determinadas garantías ni la limitación de ciertos daños, por lo que algunas de las limitaciones anteriores pueden no aplicarte. En tal caso, nuestra responsabilidad se limitará al máximo que permita la ley.
Indemnidad
Te comprometes a indemnizar, defender y mantener indemne a The Academy Lab LLC y a sus socios, administradores, empleados y agentes frente a cualquier reclamación, demanda, pérdida, responsabilidad, daño, coste o gasto (incluidos honorarios razonables de abogados) derivados de tu uso del Sitio, del incumplimiento de estas Condiciones o de la vulneración de derechos de terceros.

Cambios en estas Condiciones
Podemos modificar estas Condiciones en cualquier momento. Los cambios entran en vigor al publicarse en esta página, y la fecha de «última actualización» refleja la versión vigente. El uso continuado del Sitio tras la publicación implica que aceptas las Condiciones revisadas.
Ley aplicable y jurisdicción
Estas Condiciones y cualquier controversia derivada de ellas o del Sitio se rigen por las leyes del Estado de Nuevo México, Estados Unidos de América, sin atender a sus normas de conflicto de leyes. Aceptas que cualquier controversia se someta en exclusiva a los tribunales estatales o federales del condado de Bernalillo (Nuevo México) y consientes su jurisdicción personal.
Nulidad parcial y acuerdo íntegro
Si alguna disposición de estas Condiciones se declarara inexigible, se limitará o suprimirá en la medida mínima necesaria y el resto seguirá plenamente vigente. Estas Condiciones, junto con la Política de privacidad y el Descargo de responsabilidad, constituyen el acuerdo íntegro entre tú y nosotros respecto del Sitio. La no exigencia de una disposición no supone su renuncia.
Idioma
Estas Condiciones se publican en inglés y español. La versión inglesa es la vinculante. La traducción al español se ofrece únicamente por comodidad; en caso de conflicto o discrepancia, prevalece la versión inglesa.
